MSME Innovative Scheme: Intellectual Property Rights (IPR)

Overview

The Intellectual Property Rights (IPR) component of the MSME Innovative Scheme is designed to empower Micro, Small and Medium Enterprises (MSMEs) by fostering awareness, protection, and commercialization of their intellectual assets. The scheme provides financial assistance and professional guidance to facilitate the registration and enforcement of various forms of intellectual property, including patents, trademarks, geographical indications (GI), industrial designs, and copyrights.

Objective

To enhance the innovation ecosystem among MSMEs by providing structured support for safeguarding their intellectual creations and improving their market competitiveness both domestically and globally.

Key Features
  • Financial Assistance for IPR Filing:
    Reimbursement of costs related to filing, processing, and registration of intellectual property.

  • Awareness and Capacity Building:
    Organization of workshops, seminars, and training programmes on IPR for MSMEs.

  • Support through IP Facilitation Centres (IPFCs):
    Establishment of Intellectual Property Facilitation Centres across the country to provide end-to-end support services.

Note: Reimbursements are subject to actual expenses incurred and approval by the Ministry of MSME.

Eligibility Criteria

For MSMEs:

  • Must be registered under the Udyam Portal as a Micro, Small, or Medium Enterprise.

  • Should have valid documentation supporting the IPR filing.

  • Must submit the claim through an approved IP Facilitation Centre or directly via the scheme portal.

For Intellectual Property Facilitation Centres (IPFCs):

  • Eligible institutions include MSME-DIs, industry associations, technical institutes, R&D organisations, and NGOs.

  • Must have expertise in intellectual property services and infrastructure to support MSMEs.

Application Process
  1. For MSMEs:

    • File the respective IPR through a registered agent or IP Facilitation Centre.

    • Submit a reimbursement claim with all required documents via the official portal:

  2. For IP Facilitation Centres (IPFCs):

    • Institutions may apply to be recognized as an IPFC by submitting a detailed proposal.

    • Once approved, the IPFC can support MSMEs under the scheme as an implementing partner.

Monitoring & Evaluation
  • Reimbursement claims and IPFC performance are evaluated by a screening and selection committee constituted by the Ministry of MSME.

  • Periodic review of impact, registration success rates, and commercialization efforts.

Expected Outcomes
  • Increased number of IP filings by MSMEs.

  • Enhanced awareness of intellectual property rights in the MSME sector.

  • Strengthening of IP support infrastructure through regional IPFCs.
